Terms of Service

These Terms of Use constitute a legally binding agreement between you and ENIKEYS (“Company”, “we”, “us”, or “our”) governing your access to and use of the Site and the Marketplace Offerings (virtual products). By accessing the Site and/or the Marketplace Offerings, you agree to be bound by these Terms of Use. If you do not agree, you must discontinue use immediately.

Supplemental terms may be posted from time to time and are incorporated by reference. We may change these Terms by updating the “Last updated” date; continued use after changes are posted means you accept them.

The Site is not intended for distribution or use where it would be contrary to law or create registration requirements. The Site is not tailored for industry-specific regulations (HIPAA, FISMA, etc.). Users must be at least 18 years old.

Unless otherwise indicated, the Site and Marketplace Offerings are our proprietary property. Content and Marks are protected by intellectual property laws. They are provided “AS IS” for personal, non-commercial use only.

You are granted a limited license to access and use the Site and to download/print portions you properly access for personal, non-commercial use. All rights not expressly granted are reserved.

By using the Site/Offerings, you represent and warrant that your registration information is accurate and current; you have legal capacity; you are not a minor; you will not use automated means; you will not use the Site for illegal/unauthorized purposes; and you will comply with applicable laws.

If information is untrue/inaccurate/incomplete, we may suspend or terminate accounts. Unauthorized marketplace offerings and prohibited content may result in termination and a lifetime ban.

We are a service provider and do not make representations regarding safety, effectiveness, adequacy, accuracy, availability, prices, ratings, reviews, or legality of information or offerings displayed.

You may need to register to access Marketplace Offerings. You are responsible for keeping your password confidential and for all activity on your account.

We may remove, reclaim, or change usernames we deem inappropriate, obscene, or objectionable.

Offerings are subject to availability; we cannot guarantee stock. Some offerings may be available exclusively online. We may limit quantities, change descriptions/pricing, or discontinue offerings at any time.

We do not warrant that the quality of offerings will meet your expectations or that site errors will be corrected.

Accepted payment methods include Visa. You agree to provide current and accurate purchase/account information and keep it updated. Taxes may be added as required. Payments are in U.S. dollars.

We may refuse orders and may limit/cancel quantities per person, household, account, payment method, and/or billing/shipping address. We may limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.

You may not use the Site for purposes other than those for which it is made available, or in connection with commercial endeavors not endorsed by us. Prohibited activities include, without limitation, scraping or collecting data, automated account creation, impersonation, abuse of support, attempts to obtain sensitive information, profile transfers, harassment, reverse engineering, bypassing access controls, malware, spam, and use inconsistent with applicable laws.

The Site does not offer users the ability to submit or post content. If contributions are provided in any context, they must not infringe third-party rights, must not be unlawful or objectionable, and must comply with the requirements stated in these Terms.

The Site may contain typographical errors, inaccuracies, or omissions. We may correct and update information at any time without prior notice.

The Site and Marketplace Offerings are provided on an as-is and as-available basis. Use is at your sole risk.

To the fullest extent permitted by law, we disclaim warranties, whether express or implied, and do not warrant the accuracy or completeness of Site content or third-party content. We are not responsible for third-party products or transactions, and you should use your best judgment and exercise caution.

We are not liable for indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, revenue, or data.

Our liability is limited to the amount paid, if any, by you to us. Certain laws may not allow some limitations, and you may have additional rights.

You agree to defend, indemnify, and hold us harmless from claims and demands arising out of your use of the Site or Offerings, breach of these Terms, violations of rights, or harmful acts toward others.

We maintain certain data you transmit for performance management. You are responsible for your data; we are not liable for loss or corruption, and you waive related claims.

You consent to electronic communications and agree they satisfy legal writing requirements. You agree to electronic signatures, records, and delivery of notices, policies, and transaction records.

These Terms and any posted policies constitute the entire agreement. Failure to enforce is not a waiver. We may assign rights or obligations. If a provision is unlawful or unenforceable, it is severed without affecting the remainder. No partnership, employment, or agency relationship is created.
